REPORT OF MEETING OF THE ARTHUR BOARD OF ZONING APPEALS
VILLAGE OF ARTHUR, ILLINOIS
TO: PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ARTHUR, ILLINOIS
A meeting of the Arthur Board of Zoning Appeals was held at
the Village Council building at 5:05 p.m. on Thursday, May 6, 2010
with the following members present: Kerry Pate, James Yoder, Royal
Beals, John Mammoser and Virgil Chandler. Also present were
Village Attorney Bob Crossman and Petitioner Myron Gingerich.
The variance requests that a residential usage be allowed in
an Industrial District at 117 E. 2d St., in the Village of Arthur,
Illinois corporate limits.
After presentation of information and discussion and questions
from Board members, no objections on file and none made at the open
hearing, it was moved and seconded to recommend approval of the
variance request subject to the following restrictions:
A. Residential use is limited to owner-operator of the
business carried out upon the subject property, and can include
immediate family.
B. No lease of the residential usage is allowed.
Motion carried by a vote of 5 aye,0 opposed and 3 absent.
By general consensus, the Board indicated that they did not
favor amending the Zoning Code to allow residential use in
Industrial zones except through the variance process.
